Fort Myers real estate process
The main elements comprising the real estate sale and purchase process include:
Offer to purchase
The offer to purchase states the buying price being offered, the closing date for the sale, and contingencies that must be met. For a buyer, the contingencies include building and sewer inspections, financing terms, land survey, and any other appropriate contingencies. Seller’s contingencies usually focus on financing.
Counteroffer
The seller's responses to an offer may be to accept, reject, or counteroffer. A counteroffer proposes different terms for the sale, either modifying the buyer's terms or suggesting other contingencies and terms entirely.
The counteroffer process may go back and forth between parties, negotiating terms until both buyer and seller reach an agreement. A real estate lawyer can advise and help throughout the counteroffer negotiation process.
Closing
Real estate closing occurs on the closing date included in the purchase offer. Prior to closing, both parties have the opportunity to address any new issues encountered with the title, defects, or financing. When all contingencies are agreed upon, amendments are incorporated into the documents, and the extensive paperwork is finalized, the closing concludes. The lawyer ensures the deed is filed with Lee County Recording Office for Official Records/Land Records.
